The judge based her decision that the work in which Guardia Jaén would be doing – as a legal assistant in a law firm – was too demanding for the health situation “that the applicant presents.”
She considered that it could be wrong for her to accept that Guardia Jaén enjoyed this job offer, when his health has been impaired by problems such as gastritis, and back pain, among others.
At the hearing, it was learned that Esperanza Juárez, the first wife of Guardia Jaén, had offered to be guarantor of this petition. To do this, she made her address available.
However, the judge said that, due to the work of Juarez, the faithful compliance with the rule of freedom under surveillance could not be guaranteed. Even during the hearing on Monday, Juarez asked permission from the judge to attend to business, an action that Caballero also took into account to support her decision.
This is the second time this petition has been denied to Guardia Jaén, and he is back in El Reneacer.
