Ricardo Martinelli Requests that the Unconstitutionality Claim be Submitted to the Full Panama Court

Judge Olmedo Arrocha has a lawsuit in his office against the investigative resolution that was carried out on Martinelli in 2020.

Former President Ricardo Martinelli asked Judge Olmedo Arrocha, pictured below, to submit to the Supreme Court of Justice the unconstitutionality claim against the investigative resolution of June 30, 2020.  The pleadings in this lawsuit were filed in December, but Martinelli is still waiting for a ruling.  “I have a claim of unconstitutionality in the Court, that has been going on for several months and they have not yet ruled on it. I respectfully ask Judge Arrocha to submit it to the full court,” said the former president.  In this regard, Martinelli calls for justice and claims that he was unjustly disqualified and convicted in a case (New Business) in which he is innocent. 

According to the former president, this situation has put his life and health at risk, which is why he considers it important that the process be attended to as soon as possible.  This week, attorney Nadia Castillo filed a motion with Arrocha seeking to expedite the process within this lawsuit.  Castillo, from the firm Vega y Álvarez, challenged the order of inquiry (formulation of charges) of June 30, 2020, issued by prosecutor Emeldo Márquez in the New Business case, in disregard of the Principle of Specialty under which Martinelli was extradited on June 11, 2018 and which delimited the only four charges for which he could be accused, tried and punished in the wiretapping case.  The former president also said he would prepare a brief memo in case something happens to him….”So that the Panamanian people know who is responsible for the fact that justice has not been applied in my case,” he said.
