Call to suspend use of RM party name, logo and flag
The name Realizando Metas, (RM)which currently identifies the political party created and led by former President Ricardo Martinelli, is in the midst of a controversy over industrial property rights.
Om Thursday, May 18, Neftalí Jaén, on behalf of JW Enterprises Inc, filed an appeal before the Electoral Tribunal (TE) to suspend the use of the name, logo, flag, and emblem of the Realizando Metas party.
In the letter to the TE, it is stated that the political group has not formally registered the use of these emblems.
Likewise, it is stated that the trademark “Achieving Goals and Design” formally belongs to JW Enterprises since December 15, 2020, and that it is valid for 10 years.
The party that claims the exclusive use of the brand also states that the political party Realizando Metas has its recognized legal existence since March 24, 2021.
“Given this situation that has never arisen before, it is the responsibility of the plenary of the Electoral Tribunal to hear about this controversy as determined by numeral 3 of article 143 [of the Constitution].”
Article 143 of the Constitution refers to some of the powers that the Electoral Tribunal has and specifically in numeral 3 it is reflected: Regulate the Electoral Law, interpret and apply it, and hear the controversies that its application originates.
