Draft court ruling  sends  “dangerous and disastrous message”

 

The controversial draft ruling under the umbrella of magistrate Cecilio Cedalise who would seek to review a lawsuit filed by the defense of former President Ricardo Martinelli related to the illegal wiretapping case would send “a dangerous and disastrous message”, said the former deputy and dean of the Faculty of Law of the Santa María   Antigua University (Usma), Ana Matilde Gómez in statements to AM News on Friday, October 22.

The previous idea adds to the premise that ” the message is dangerous, especially because of the times the country is living

From a legal point of view, Gómez stressed that the ruling by Judge Cedalise is ” res judicata, there is no room for review.”

” All jurists are surprised that the Court returns to address an issue that it had already resolved, ” said the former Attorney  General the dean of the Faculty of Law.

The ruling that caused the annoyance of Magistrate Cedalise for an alleged leak is in the hands of the Plenary of the Supreme Court of Justice, according to Cedalise himself said last Thursday, October 21 after being approached by TVN Noticias.

If this ruling becomes a reality, the crisis of justice in Panama would deepen, Gómez said.

It would be evident that when politics is commercialized and justice is politicized, whoever has  economic power and political power can make a tailor-made suit,” said the former  independent deputy.
