Martinelli hearing adjourned until Jul. 30

The indictment hearing of ex-president, Ricardo Martinelli, was suspended on Monday, July 24 because of a three-day disability certificate presented by the prosecutor, Judge Harry Diaz.

The hearing was to have resumed after several days of recess, granted by the Judge of Guarantees, Jerónimo Mejía, to the prosecutor and an autonomous complainant to answer objections from the defense on the indictment.

Martinelli was also not taken to the audience said to be suffering from a hernia “and will undergo medical examinations.” He has previously been  examined  by forensic medicine specialists for high blood pressure and palpitations

His  legal team has  asked  Díaz for the general identification of a protected witness,  and documentary evidence that has not  yet been provided and documents

In an interview with TVN News, lawyer Carlos Carrillo reported that these issues were resolved with the prosecutor and an independent lawyer.

The audience also occurs in the middle of another element: conversations that explore the possibility of a penalty agreement, something that by law is only valid to negotiate between the Office of the Prosecutor and the accused.

Martinelli’s lawyers reiterated on Tuesday that an agreement will not be requested.

During the last week, Martinelli’s they have suffered several defeats. The Plenary of the Supreme Court of Justice (CSJ), did not admit an amparo of constitutional guarantees against a decision of the Judge of Guarantees and rejected an appeal against a supposed double judgment in the wiretapping case.
