Court rejects Martinelli era   wiretapping appeal

The Second Criminal Chamber flatly rejected as inadmissible the requests for clarification of the sentence presented by Alejandro Garuz and Gustavo Pérez in the case of illegal wiretapping from the National Security Council (CSN).

The briefs were presented by Carlos Carrillo and Aura Emérita Guerra de Villalaz, lawyers for Garuz and Pérez, respectively, who sought to modify the confirmation of the sentence issued by the Criminal Chamber on March 7, 2023.

Said confirmation was based on the 50 months in prison against Garuz and Pérez as responsible for the crime of inviolability of secrecy and against privacy that was issued in the second instance by the Superior Court for the liquidation of Criminal Cases, on February 18, 2020.

The decision was adopted by the magistrates Ariadne García Angulo (speaker), María Eugenia López, and Otilda de Valderrama and it appears on the mural of edicts of the Criminal Chamber.

Garuz and Pérez served as general secretaries of the CSN in the government of Ricardo Martinelli, currently both maintain a measure preventing them from leaving the country.
