Judges reject Electoral Prosecutor appeal of immunity lifting

ELECTORAL prosecutor Eduardo Peñaloza has lost his appeal to prevent the lifting of immunity from criminal prosecution. It was rejected by The judges of the Electoral Tribunal (TE).

  Penaloza presented the appeal January 8, after judges agreed to lift his immunity at the request of the Attorney General.
The prosecutor faces a complaint filed by the National Lawyers for alleged breach of his duties.
According Penaloza, who is on vacation – the complaint filed against him is “devoid of conclusive evidence.”
On January 12 the electoral courts canceled his immunity for the second time following a complaint filed by Carlos Rubio, acting president of the Popular Party (PP), ton September 30, 2014.
According to Rubio, Penaloza has “ignored his constitutional and legal functions, allowing dirty campaigns and other election crimes”.
